End User Privacy Policy

Introduction

Envision EV Charging (herein referred to as “Envision EV”, “we”, “our” or “us”) provides this privacy policy (the “Policy”) to set out what personal information we collect, for what purposes, and your rights in this respect. This Policy sets out to inform our end users and the public at large of our adherence to the principles of transparency, legitimate purpose, and proportionality and such other relevant requirements in the collection, processing, storage, transmission and retention of personal information as required by the Philippine Data Privacy Act of 2012 (“DPA”), its implementing rules and regulations and other applicable privacy laws.

 

This Policy applies to your use of the Envision EV Charging website (the “Website”), the Envision EV Charging mobile application (the “App”), and to any service offered by Envision EV Charging that includes a link to this Policy. Each of these services and applications are collectively defined as “Services”.

 

Consent

In compliance with Republic Act No. 10173, or the Data Privacy Act of 2012 (DPA), we will require your informed and voluntary consent before collecting, processing, and storing your personal information. By creating and verifying an account and using our Services, you acknowledge that you have read, understood, and agreed to our data processing policies as outlined in this document.

You have the right to withdraw your consent at any time by contacting us through the details provided below. However, please be advised that certain personal information is essential for the proper functioning of our Website, App, and Services, including the full experience of Envision EV Charging. If you choose to withhold or request the deletion of your personal data, this may result in the limitation or loss of access to some or all of our Services.

By proceeding with account creation and continued use of our Services, you agree that we shall not be held liable for any inconvenience or claims arising from your decision to withdraw consent or limit data processing.

Definition

Unless otherwise stated, terms used herein shall have the same meanings ascribed to it under the DPA and other applicable privacy laws. For reference, below terms shall be defined as follows: 

  1. Data subject refers to an individual whose personal information is processed for the usage of Envision EV Charging.
  2. Personal information refers to any information whether recorded in a material form or not, from which the identity of a Data subject is apparent or can be reasonably and directly ascertained by the entity holding the information, or when put together with other information would directly and certainly identify an individual. For avoidance of doubt and in the context of this Policy, this includes privileged information and sensitive personal information as defined below.
  3. Processing refers to any operation or any set of operations performed upon personal information including, but not limited to, the collection, recording, organization, storage, updating or modification, retrieval, consultation, use, consolidation, blocking, erasure or destruction of data.

 

  1. Privileged information refers to any and all forms of data which under the Rules of Court and other pertinent laws constitute privileged communication.

 

  1. Sensitive personal information refers to personal information: (a) About the Data subject’s race, ethnic origin, marital status, age, color, and religious, philosophical or political affiliations; (b) About the Data subject’s health, education, genetic or sexual life, or to any proceeding for any offense committed or alleged to have been committed by such Data subject, the disposal of such proceedings, or the sentence of any court in such proceedings; (3) Issued by government agencies peculiar to the Data subject which includes, but not limited to, social security numbers, previous or current health records, licenses or its denials, suspension or revocation, and tax returns; and (4) Specifically established by an executive order or an act of Congress to be kept classified.

 

Information Collection

We gather information about you when you use or obtain access to our Services. The following are the ways on how we collect and process information from end users.

  • Account Registration Information: If you register for an account, we will collect information about your personal circumstances such as but not limited to your name, age, address, birthdate, email address, password, phone number, and RFID card number.
  • Vehicle information: In order to provide proper estimates for the use of our Services, we may request for your electric vehicle’s battery capacity, its current state of charge and other relevant information of your electric vehicle.
  • Payment information: For us to process your payments, your credit or debit card details may also be requested. One-Time PIN/Password (“OTP”) and card details such as expiry date and CVV/CVC may be required when prompted by an external link to complete the transaction but shall not in any way be construed as Processing under this Policy; hence, shall not hold us liable for any privacy-related violation therewith.
    • Issue Reports: In case an issue is submitted through our contact information in relation to the use of our Services, we will request the user identification and such other details necessary to properly address the issue raised. 
  • Charging Station Data: If you own or operate a Charging Station for commercial use (a “Site Host”), we may collect information regarding your business registration, authorized representative/s, geolocation and such technical information used for operating a Charging Station.

We may collect and process personal information about you that is shared with us by our Affiliates and other third-party service providers.

 

Please note that while we engage with these third parties, we do not have control over their data processing activities, security measures, or privacy policies. We strongly advise you to review their respective privacy policies to understand how your personal data is processed and protected.

 

Below are some of the third-party service providers we work with and their roles in data processing:

  • Amazon Web Services (AWS) – Provides cloud storage services for data.
  • PayMongo – Facilitates online payment processing.

By using our Services, you acknowledge that certain personal data may be collected and processed by these third parties in accordance with their respective privacy policies. We are not responsible for any data processing activities undertaken by these entities beyond what is necessary for providing our Services.

The following information are automatically collected, processed and stored pursuant to your use of our Services:

  • Charging Session Information: While using our App, your charging session date, start time, end time, duration, identification number, energy dispensed, charger identification number, total fees associated with each charging session, pricing policy applied and RFID Card Identification Number are automatically generated.
  • Billing Information: To process payment for using our Services, your reference number from payment gateway, exact amount paid, time of payment, payment method used, refund amount and status, if any, are automatically collected. 
  • Device/Usage Information: We and our Affiliates/Non-Affiliates may use cookies, sessions, and other tracking technologies to collect and store information about your use of the Website.
  • Location Information: If you install our App, we will ask you to grant us access to your mobile device’s precise geolocation data and use that information to improve our Services including providing you with location-based features (e.g. identification of Charging Stations available near you). If you reject our access request, you may not be able to use certain parts of our Services.

 

Information Use

We ensure that the information collected about you will not be disclosed, processed, appropriated, modified or expunged without your consent. Collection and processing of personal information shall be limited to the following purposes:

  • Providing our products and services to you.
  • Account management including account verification (to ensure that only you can access your account and information).
  • Storing, deleting and anonymizing your personal information.
  • Payment processing and financial account management.
  • Customer service and technical assistance.
  • Audits, investigations, dispute resolutions, and litigation of defense of claims.
  • Statistical, historical or scientific research for the development of our products and Services.
  • Legal and/or regulatory compliance.

 

Information Storage

Our App utilizes AWS, which may be located in various regions globally, to safely store and manage the information collected from the end users. AWS implements encryption, access controls, and other security measures to safeguard your information against unauthorized access, disclosure, appropriation, modification or loss. Your information may be transferred to and stored on servers outside your jurisdiction as part of the AWS infrastructure. Rest assured that any such transfer is conducted in compliance with applicable data protection laws. Information Retention

Your personal information shall be retained as long as you keep an active status or registration in our Website or App. Further, we will retain your personal information for other legitimate business purposes, such as but not limited to, business, tax, or for legal compliance, and until such duration required by applicable law, our records retention policy, internal reporting or reconciliation purposes, or to fulfill any feedback or information requests from you. Notwithstanding, this retention period will be subject to periodic review and may be adjusted accordingly.

 

Information Security

We are committed to safeguarding your personal information. We will implement reasonable and appropriate organizational, physical and technical security measures, including encryption, intended for the protection of your personal information from any accidental or intentional breach or unauthorized use. For instance, when using your credit card, a third party provider will process it. But if you allow us to provide vaulting service (secure way of storing credit card data for future use), we will only keep the last four digits of your credit card number, the expiry date and your CVV/CSC.

 

Information Disclosure

Except as otherwise described in this Policy, we will not disclose your personal information to any unrelated party unless required to do so by law, court order, or legal process (e.g., subpoena) in order to respond to any government, regulatory, or licensing request, or if we believe that such action is necessary to: 

  • prevent, investigate or take action in a potential or actual illegal and unauthorized activities; 
  • defend ourselves from third-party claims or allegations; 
  • assist appropriate government enforcement agencies in the protection of personal information and data in general;
  • protect the security or integrity of our Websites, App and/or Services; 
  • protect the rights, property and personal security of the end users.

 

Data Rights under Data Privacy Act

 

You have the right to access, modify, delete, or restrict the processing of your personal information, as well as exercise other data protection rights. These include:

  • Right to be Informed – You have the right to be notified about how your personal data is collected, processed, stored, and shared.
  • Right to Access – You may request a copy of the personal data we have about you.
  • Right to Object – You can refuse the processing of your personal data if it is based on consent or for direct marketing, profiling, or automated processing.
  • Right to Rectification – You have the right to correct or update inaccurate or incomplete personal data.
  • Right to Erasure or Blocking – Under certain conditions, you may request the suspension, removal, or destruction of your personal data.
  • Right to Data Portability – You have the right to obtain and transfer your personal data in an electronic or structured format.
  • Right to File a Complaint – If you believe your data privacy rights have been violated, you may file a complaint with the National Privacy Commission (NPC) or other appropriate authorities.

 

Children's Information

Our Website, App and/or Services are not designed for children and we do not require nor process any personal information relating to children. If we receive information about their personal information being processed, we undertake to remove it promptly and without delay. Alternatively, you may also send requests for the removal of children' s personal information in our Website or App by contacting us through our information provided below.

 

Changes to Privacy Policy

We reserve the right to amend this Policy at any time without prior notice. In the event changes are made, the same shall be posted on our Website and/or App immediately. Please check the latest information posted or notification sent to inform yourself of any changes.
